CHICO OAKS HOA

RULES & REGULATIONS

 Adopted by the Board of Directors

These rules are set out to serve as a guide for cooperation by COHA residents and to enhance the appearance of the complex. The Common Area referred to in these rules is all the real property owned by the Association for the common use and enjoyment of the residents. The carports are included in the Common Area; the patios are not.

Keep in mind that this may not be the most current set of rules. Check with management. Also, this is by no means all the rules. More rules, along with more specific information on the rules below, can be found in the CC&R's, By-Laws, Landscape Rules and Architectural Rules.

HEALTH, WELFARE AND SAFETY

1. Skate boards, roller skates, or other rolling equipment may be used in the basketball court area, but not in Common area driveways or sidewalks.

2. Children may not play in the driveways of the common areas.  

3. The speed limit of 5 mph for the operation of motor vehicles is to be observed at all times.

4. Motor vehicles are to be operated in a safe manner at all times. Reckless driving or squealing of tires is not allowed. Motor vehicles are not to be used off the asphalt portions of the premises.

5. Residents are responsible for disposing of large items that do not fit in the dumpster.

6. Toxic materials such as engine oil, freon, and car batteries, are not to be left in the dumpster or common areas. Call 343-5488 for information regarding free disposal of these items.

7. Noise is to be confined to the interior of one's own unit.

8. Owners must accompany and restrain their pets when in the common areas.

9. The owner is responsible for the clean-up of any waste left, or damage caused, by their pet.

10. Pets are not allowed in the pool, pool enclosure, cabana, or tennis area.

11. Pets are not to disturb other residents.

 

MAINTENANCE AND APPEARANCE 

Carports and Parking

1. Unlicensed or inoperable vehicles may be parked in carports or in parking spaces of the Common Area for a maximum period of 30 days, to allow for the owner to get the vehicle operable. Vehicles are subject to towing after 30 days,

2. Parking on COHA premises is limited to residents and their guests.

3. Storage of boats, RVs, and trailers is allowed in carports only, as long as they do not extend beyond the roof-line of the carport.

4. Parking is allowed only in designated areas and at no time may a parked vehicle impede access by other vehicles.

5. Carports may be used for vehicle repairs requiring less than 24 hours. Repairs requiring more time must be completed off-site.

6. Residents are to maintain their carports in a neat and orderly condition. Furniture, boxes, and equipment are to be stored elsewhere.

7. The addition of storage cabinets to the carport must be approved by the Architectural Committee.

Individual Units

Any changes or additions to the exterior of a unit (awnings, screen doors, exterior blinds, windows, etc.) must be approved by the Architectural Committee.

2. Satellite dishes that are less than 1 meter in diameter may be installed, but require Architectural Committee approval if they are going to be attached to siding, roofing, or any other material or structure maintained by the Association. As long as reception is not hampered, installations should not be visible from the common area or interfere in any way with the property and rights of other residents.

3. Television and ham radio antennas are not allowed.

4. For sale and for rent signs are limited to one sign for each unit, of customary and reasonable dimension and design, and placed in a manner that does not affect public safety.

5. Political signs may be displayed from individual units, but not on any of the common areas

6. Personal items, including toys and lawn furniture, must be stored within the individual unit, not in the common areas, when not in use.

 

RECREATION FACILITIES: SWIMMING POOL AND TENNIS COURT

1. The pool, tennis court, and common areas are for the exclusive use of residents and their guests. Residents must accompany guests when using recreational facilities and common areas.

2. Pool Hours are from 6:00 a.m. to 11:00 p.m.

3. The gate to the pool is to be kept locked at all times.

4. As there is no lifeguard on duty at the pool, all children under 14 and non-swimmers must be accompanied by a responsible adult. THIS IS A STATE LAW.

5. 'Band-Aids, hair-clips, bobby pins, and the like are not to be worn in the pool as they clog the filter when they come lose.

6. Swimsuits must be worn by swimmers. Cutoff shorts are not to be worn in pool; raveled threads can clog the filter.

7. Children in diapers must wear plastic pants with elastic legs.

8. Nude swimming and sunbathing are not allowed by anyone.

9. Spitting, spouting water from the mouth, or discharging bodily wastes in the pool is prohibited.

10. Running or rough play is not allowed in the pool area.

11. No glass items, food, or alcoholic beverage are permitted in the pool or tennis court areas.

12.Smoking is not permitted in the pool or tennis court areas.

 

ENFORCEMENT OF THE RULES

Schedule of Fines

The Board of Directors has established a process for citing and fining individual homeowners (see Complaint Procedure). Homeowners are responsible for violations of rules by a tenant or guest.

The amount of the fines specified herein is the minimum that can be levied for each citation. The Board can levy larger fines as the degree of the violation warrants. Vehicles in violation of the parking and operational restrictions may be towed at the owner's expense following written notice.

1st Violation of a rule = Written warning

2nd Violation of the same rule within a 12 month period = 2nd written warning

3rd violation of the same rule within a 12 month period = $25.00 Fine

Additional violations of the same within a 12 month period = $50.00

Complaint Procedure

In the interest of promoting good will in the neighborhood, residents should, where appropriate, try discussing the problem (violation of a rule) with the offending party in the hopes of reaching an amicable solution. If this method is not appropriate, the following procedure is to be followed:

All complaints must be received in writinq and must specify the offending party's name and address (if possible), the date, time, place and nature of the violation. !f the complaint involves a vehicle, the license number and other identifying information must be included. Complaints must be signed and include the address of the person making the complaint. Complaints should be submitted to the management company: Chico Oaks Homeowners Association, c/o Hignell & Hignell, Inc., 1500 Humboldt Road, Chico, CA 95928. This information may be faxed, 530-894-6984. If the nature of the complaint is urgent, the same information may be phoned in first, 530-894-0404, and then followed in written form.

Management will notify the property owner and/or violator when a complaint has been registered.

Appeals Procedure.

Any resident and/or property owner receiving a warning or notice of intent to fine, has the right to appeal the action before the Board of Directors of the Chico Oaks Homeowners' Association. An appeal must be filed in writing with the property management company within 14 days from when the notice of violation or citation is mailed to the homeowner. Unless an appeal is in process, payment of all fines must be received by the property management company within 30 days of the date of notice or citation being mailed to the homeowner. If the Board rejects ar appeal, payment must be received by the property management company within 30 days of the Board hearing.
